Terms of Use

1. Acceptance of Terms

By downloading, accessing, or using Goldfish ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.


2. Use of the App

Goldfish is provided for personal, non-commercial use unless otherwise authorized by the Developer.

You agree not to misuse, reverse engineer, modify, or disrupt the App or its services.

You must comply with all applicable laws while using the App.


3. AI-Generated Content

Responses generated by the AI Assistant are for informational and entertainment purposes only.

The Developer is not responsible for the accuracy, reliability, or outcomes of actions taken based on AI-generated content.

You agree not to use AI outputs for harmful, illegal, or abusive purposes.


4. Presentation Generation

Goldfish can generate AI-powered presentations based on your prompts. Your prompts are sent to our AI provider for processing.

Generated presentations are stored locally on your device. The Developer does not store or have access to your generated presentations.

You are responsible for reviewing and verifying the content of generated presentations before use.


5. User Responsibilities

You agree to:

  • Provide accurate information when interacting with the App.
  • Not engage in harmful activities, such as spamming, harassment, data scraping, or unauthorized access.
  • Use the App only in a lawful and ethical manner.

6. Intellectual Property

All content, design, branding, code, and functionality of Goldfish are the intellectual property of the Developer.

You are granted a limited, non-exclusive, non-transferable license to use the App.

You may not copy, reproduce, or create derivative works without written permission.


7. Third-Party Services

Goldfish uses third-party providers for AI processing, analytics, authentication, and advertising attribution.

These services may process certain data according to their own terms and policies.

The Developer is not responsible for third-party actions or outages.


8. Subscription and Payments

Goldfish offers premium features through monthly and annual subscriptions:

  • Payments are processed via Apple's App Store.
  • Apple's billing and refund policies apply.
  • The Developer does not directly manage payment information.
  • Subscription purchase data (product ID, amount, currency) may be shared with analytics partners for attribution purposes.

9. Termination

The Developer may suspend or terminate access if:

  • You violate these Terms,
  • The App is discontinued,
  • Required by law.

You may stop using the App at any time.


10. Disclaimer of Warranties

The App is provided "as is" and "as available."

The Developer does not guarantee:

  • Error-free, uninterrupted, or fully secure operation.
  • The accuracy or suitability of AI-generated responses.

11. Limitation of Liability

To the fullest extent permitted by law, the Developer is not liable for:

  • Damages from using or being unable to use the App,
  • AI response errors,
  • Data loss, interruptions, or third-party failures.

Your sole remedy is to stop using the App.


12. Changes to Terms

These Terms may be updated at any time. The latest version will be available in the App or on the official website.

Continued use constitutes acceptance of updated Terms.


13. Governing Law

These Terms are governed by the laws of the Republic of Armenia unless otherwise required by your jurisdiction.

Privacy Policy

1. Introduction

This Privacy Policy explains how Goldfish ("the App") collects, uses, and protects your personal data in compliance with GDPR, CCPA, and other applicable laws.

By using Goldfish, you agree to the data practices described here.


2. Information We Collect

2.1 Automatically Collected Data

Collected through our analytics services:

  • Device model, OS version
  • Vendor identifier (IDFV)
  • Device name
  • Usage statistics and interaction data (features used, time spent)
  • App events (conversations created, messages sent, settings changes)

2.2 Anonymous Authentication

When you first launch the App, a unique anonymous user identity is created automatically. This identity is tied to your device and is used to manage your usage limits and app configuration. No personal information (such as email or password) is required.

2.3 AI Processing Data

When you interact with the AI Assistant or generate presentations:

  • Your prompts are sent to a third-party AI provider for processing.
  • The Developer does not store your conversations on servers.
  • Chat conversations and generated presentations are stored locally on your device.

2.4 Speech and Audio Data

Goldfish uses on-device speech recognition to convert your voice input to text. When you use speech input:

  • Microphone access is requested with your permission.
  • Audio is processed on-device using the platform's built-in speech recognition.
  • Audio recordings are not stored or transmitted to the Developer's servers.
  • Your device manufacturer may process speech data according to its own privacy policy.

2.5 User-Provided Data

  • During onboarding, you may provide a preferred name. This is stored only on your device and is not transmitted to any server.
  • If you contact support, we may receive your email address and any information you voluntarily provide.

2.6 Subscription and Purchase Data

When you subscribe to Goldfish premium features (monthly or annual plans), purchase transaction data — including product ID, amount, and currency — may be shared with our analytics and advertising partners for attribution and conversion tracking.

2.7 Advertising and Tracking Data

Goldfish integrates a third-party advertising attribution service. When tracking is enabled, the following data may be collected:

  • Advertiser ID (IDFA), when permitted
  • App install and launch events
  • Subscription conversion events
  • Aggregated ad network reporting data

Before collecting tracking data, the App requests your permission through the App Tracking Transparency prompt. You can choose to allow or deny tracking. If you deny tracking, no advertiser ID is collected, though limited non-identifying data may still be shared for aggregated reporting.

You can change your tracking preference at any time in your device's Settings > Privacy & Security > Tracking.


3. On-Device Data Storage

The following data is stored locally on your device and is not transmitted to our servers:

  • Chat conversations and message history
  • Generated presentations
  • Your preferred name
  • User preferences and settings
  • Cached app configuration

This data can be deleted by uninstalling the App from your device.


4. How We Use Your Information

We use data to:

  • Provide and improve the App's features
  • Generate AI responses and presentations
  • Analyze usage trends and app performance
  • Measure advertising campaign effectiveness
  • Manage usage limits and app configuration
  • Fulfill legal obligations
  • Provide support when requested

5. Data Sharing and Disclosure

We do not sell or trade personal information.

We may share limited data with the following types of partners:

  • Analytics provider — for usage analytics and anonymous authentication
  • AI processing provider — for generating AI responses and presentations
  • Advertising attribution provider — for measuring ad performance and install attribution
  • Legal authorities, if required by law

All partners must comply with secure data-handling standards.


6. Data Retention

  • Our analytics provider retains data according to its own retention policies.
  • AI prompts are temporarily processed by our AI provider and are not stored by the Developer.
  • On-device data (conversations, presentations, preferences) persists until you delete the App.
  • Support emails are kept only as long as needed.

7. Analytics and Opt-Out

Analytics is enabled when you use the App to help us understand usage patterns and improve features. Currently, the App does not offer an in-app toggle to disable analytics collection.

You can limit analytics data collection by restricting the App's network access in your device settings, or by uninstalling the App.


8. Security

We use technical and organizational measures to protect your data, including secure on-device storage of sensitive credentials. However, no system is absolutely secure.


9. Your Rights

Depending on your location, you may:

  • Request access to your data
  • Request correction or deletion
  • Withdraw consent
  • Request processing restrictions
  • Opt out of tracking via your device's Settings > Privacy & Security > Tracking

Data Deletion

On-device data (conversations, presentations, preferences) can be deleted by uninstalling the App. To request deletion of any data stored on our servers (such as your anonymous device profile and usage data), please contact us at: smbattumasyan@gmail.com

We will process deletion requests within 30 days.


10. Children's Privacy

Goldfish is not intended for children under 13.

We do not knowingly collect data from children.


11. International Data Transfers

Your data may be processed in countries with different privacy laws, including the United States.

We use appropriate safeguards to ensure compliance.


12. Updates to This Policy

Updates may occur periodically. Continued use of the App means you accept the updated Policy.
